Terms and Conditions

Bloomary is operated by DailyMind LTD, a company registered in Cyprus under registration number HE 439959. These Terms explain the rules for using Bloomary at https://bloomary.life/, the Bloomary iOS app, and related Bloomary pages and support channels.

1. Acceptance

By accessing or using Bloomary, you agree to these Terms. If you use Bloomary on behalf of a company or other organization, you confirm that you have authority to accept these Terms on its behalf.

If you do not agree with these Terms, do not use Bloomary.

2. The Service

Bloomary helps you capture insights, write LinkedIn post drafts, preview posts, save drafts locally, connect LinkedIn, publish to LinkedIn when you choose, and send feedback to us.

We may add, change, limit, suspend, or remove features for security, reliability, legal, product, or business reasons.

3. Eligibility and Account Access

You must be legally able to use Bloomary and to connect any LinkedIn account you choose to use with it. You are responsible for keeping your device, browser profile, LinkedIn account, and app access secure.

If you connect LinkedIn, you must use an account that you are authorized to access. Do not impersonate another person or misrepresent your identity or affiliation.

4. LinkedIn

Bloomary uses LinkedIn sign-in and publishing permissions only for features you choose to use. LinkedIn is a third-party service and has its own terms, policies, limits, review rules, and availability.

You are responsible for complying with LinkedIn rules. DailyMind LTD is not responsible for LinkedIn rejecting, limiting, removing, or changing access to any content, account, API, or permission.

Bloomary is not an automation tool and does not create or publish posts on its own. Every post, including a scheduled post, is written or approved by you and is published only when you submit it or at the time you schedule it.

LinkedIn does not provide support for Bloomary. For Bloomary support, contact us using the details in Section 21.

Bloomary is not affiliated with, endorsed by, sponsored by, or officially connected with LinkedIn. LinkedIn trademarks belong to their respective owner.

5. Your Content

You own the text, drafts, images, feedback, and other materials you create or provide through Bloomary, subject to any rights held by other people or third parties.

You give DailyMind LTD a limited permission to process your content only as needed to provide Bloomary, publish content when you request it, send feedback messages, prevent abuse, maintain security, debug issues, and comply with law.

You are responsible for making sure your content is lawful, accurate enough for your use, and does not violate confidentiality, intellectual property, privacy, employment, platform, or other obligations.

Do not upload or publish confidential, regulated, client, employer, or third-party material unless you have the right to use it.

6. Local Drafts and Data

Bloomary is designed to keep drafts local where possible. Drafts may remain on your device, browser profile, or app storage until you delete them, clear storage, disconnect, or remove the app.

Keep your own copy of drafts that matter to you. You can export your synced drafts from Settings. Drafts stored only on your device are lost if you clear storage or remove the app.

Data handling is described in the Privacy Policy.

7. Acceptable Use

You must not use Bloomary to:

• break applicable law or platform rules;
• publish content that infringes intellectual property, privacy, or confidentiality rights;
• send spam, deceptive messages, harassment, threats, or unlawful promotions;
• misrepresent yourself, your company, your results, or your relationship with another person;
• probe, overload, attack, reverse engineer, or bypass security of Bloomary or related systems;
• upload malware, harmful code, or content intended to damage another system;
• use automation or scraping against Bloomary unless we explicitly allow it in writing.

8. AI Assistance

Bloomary may include AI-assisted writing or restructuring features. AI output can be incomplete, inaccurate, too generic, or inappropriate for your context. You are responsible for reviewing and editing any AI-assisted output before using or publishing it.

AI assistance currently uses Google Gemini API with a Gemini API key that you provide. You are responsible for your Google account, API key, quota, billing status, regional eligibility, and compliance with Google's Gemini API terms. Bloomary sends your draft and Gemini API key directly to Google Gemini API only to process the AI assistance request. DailyMind LTD does not receive or store your draft, generated output, or Gemini API key for this feature.

We are not responsible for whether a third-party Gemini API key works, remains valid, has quota, has billing enabled, is available in your region, is accepted by Google, or is restricted correctly for Gemini API. Free, unpaid, restricted, unrestricted, old, blocked, expired, revoked, or incompatible keys may fail.

Free or unpaid Gemini API quota may have different data-use terms from paid Gemini API usage, including possible product-improvement use and human review by Google. Do not use AI assistance for sensitive, confidential, client, employer, regulated, or third-party material unless you are allowed to send that material to Google.

AI assistance depends on Google Gemini API models, endpoints, and behavior that Google may change, restrict, or discontinue at any time. If a provider change breaks AI assistance, we will try to release an updated app version, but we do not guarantee that AI assistance will work, remain available, or be restored within any timeframe. AI assistance is provided as-is and is not a guaranteed part of the service.

Bloomary is intended to help you express your own work more clearly, not to replace your judgment, identity, expertise, or responsibility.

You must verify names, claims, facts, numbers, results, and offers before publishing.

9. Feedback

If you send feedback, bug reports, screenshots, feature ideas, examples, or other suggestions, you allow DailyMind LTD to use them to understand, improve, develop, market, and support Bloomary without owing compensation.

Do not send confidential information as feedback unless you are comfortable with us using it for support and product improvement.

10. Payments, Renewal, and Refunds

Bloomary may offer free access, a free trial, paid subscriptions, paid features, or special access. Current pricing is shown on the Pricing page. New accounts receive a 14-day trial with all Bloomary Pro features, once per person. Deleting your account and signing up again does not start a new trial. The trial needs no payment details and ends automatically.

Paid subscriptions renew at the end of each billing period (monthly or yearly, depending on the plan you choose) unless canceled before renewal. Cancellation stops future renewal but does not automatically refund fees already charged for the current billing period.

Web subscriptions are sold by Paddle.com, which acts as our reseller and merchant of record. Paddle appears on your bank or card statement and provides first-tier support for billing, refunds, payment, and order-related questions. iOS subscriptions are sold and billed by Apple through the App Store under Apple's terms.

If your trial or paid subscription ends and you do not subscribe, your drafts become read-only. You can still read, copy, and export your existing drafts on any of your devices, and save new drafts until you have 5 drafts in total. Without an active subscription, saved drafts cannot be edited or deleted, posts cannot be published to LinkedIn or scheduled, and AI clients connected through MCP cannot access your drafts. Posts you scheduled while your access was active will still be attempted at the scheduled time (see Section 14). You can delete your account and all your data at any time.

Refunds are handled under the Refund Policy.

11. Third-Party Services

Bloomary may rely on or link to third-party services, including LinkedIn, Cloudflare, Google Gemini API, Resend, Sentry, Telegram, Apple, and payment providers. We are not responsible for third-party services, websites, policies, outages, changes, or decisions.

12. Community

Bloomary may provide access to a Telegram community for support, feedback, product discussion, and peer exchange. Bloomary does not currently use Telegram statistics bots.

By joining the community, you agree to follow the community rules, avoid spam and abuse, and understand that admins may remove messages, restrict access, or ban accounts to protect the group.

13. Intellectual Property

Bloomary, including its software, design, brand, interface, text, workflows, and related materials, belongs to DailyMind LTD or its licensors. These Terms do not transfer any ownership rights to you.

You may use Bloomary only as allowed by these Terms and the app features we make available to you.

You must not reverse engineer, decompile, disassemble, copy, scrape, probe, scan, stress test, penetration test, bypass access controls, or otherwise attempt to discover source code, vulnerabilities, non-public APIs, infrastructure, or security weaknesses in Bloomary, including its website, apps, domains, subdomains, APIs, servers, and connected systems, without our prior written permission.

14. No Guaranteed Results

Bloomary may help you write, clarify, preview, save, and publish better posts. We do not guarantee followers, reach, impressions, engagement, trust, leads, revenue, offers, sales, jobs, partnerships, or any other outcome.

Scheduled publishing depends on LinkedIn, your LinkedIn connection, and our systems. We do not guarantee that a scheduled post will be published, or published at the exact scheduled time. Check LinkedIn after the scheduled time.

15. Disclaimers

Bloomary is provided on an as-is and as-available basis. We do not promise that Bloomary will be uninterrupted, error-free, secure against every risk, compatible with every device or browser, or available at all times.

We do not provide legal, financial, employment, tax, marketing, or professional advice through Bloomary.

Some Bloomary users may be therapists, coaches, consultants, or other professionals. Bloomary is still a writing and LinkedIn publishing tool, not therapy, coaching, clinical software, or a professional-client records system. Do not use Bloomary to store or process client records, patient records, health data, or other regulated professional records.

16. Limitation of Liability

To the maximum extent permitted by applicable law, DailyMind LTD will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill, lost data, or platform account issues.

To the maximum extent permitted by applicable law, DailyMind LTD's total liability for claims related to Bloomary is limited to the amount you paid for Bloomary in the 12 months before the claim, or EUR 50 if you used Bloomary for free.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

17. Indemnity

You agree to protect DailyMind LTD from claims, losses, liabilities, damages, costs, and expenses arising from your content, your use of Bloomary, your violation of these Terms, or your violation of law or third-party rights.

18. Suspension and Termination

We may suspend or terminate access to Bloomary if we reasonably believe that you violated these Terms, created legal or security risk, misused the service, or if continued operation becomes impractical for legal, technical, or business reasons. We may also refuse service at our discretion without giving a reason, where permitted by applicable law.

You may stop using Bloomary at any time. You can export your drafts, disconnect LinkedIn, delete your account and all your data, clear browser storage, or remove the app.

19. Changes to These Terms

We may update these Terms from time to time. The updated date above shows the current version. Continued use of Bloomary after changes means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the Republic of Cyprus, unless mandatory consumer protection law in your country requires otherwise.
